HC to State Legal Services: Why have you not appointed PLVs in Police Stations,

The Delhi High Court has sought immediate response of State Legal Service Authority as to operationalising  of NALSA's Scheme for Para-Legal Volunteers providing their presence in police stations, in order to apprise arrestees of their legal rights.

The Division Bench comprising of Justice Siddharth Mridul and Justice Anup J Bhambhani was dealing with a criminal reference concerning implementation of various provisions of Juvenile Justice Act. 

The minutes of meeting handed over to GNCTD team regarding meet of concerned persons reflect that at the meeting it was decided that insofar as the place of sitting and other basic amenities for ParaLegal Volunteers (PLVs) in 50 Police Stations is concerned, the same has been verified by the concerned Secretaries of the District Legal Services Authority (DLSAs) and these arrangements have been found to be in order except in one Police Station, i.e. P.S.: Harsh Vihar, where these aspects remain to be inspected.

It was further decided at the said meeting, that a co-ordination meeting shall be organized in each district, at which the S.H.Os of the concerned police stations, representatives of the DLSA and the PLVs, would be introduced to each other; and the names and phone numbers of the PLVs, deputed at such Police Stations along with the names of the Nodal Persons of the DLSAs in each district, would also be made available.

Upon a query raised by the court, Mr. H.S. Phoolka, learned senior counsel, who is Amicus Curiae in the matter, as well as Mr. Anant Kumar Asthana, learned counsel appearing on behalf of the DSLSA as also Mr. Sanjay Lao submit that the PLV Scheme be permitted to be rolled-out at this stage, restricting its functioning only to matters relating to missing children and matters involving minors; and expansion of the role of PLVs may be considered at a subsequent stage. 

Accordingly, the Secretary, DSLSA has been directed to file a status report on the attachment of PLVs to the 50 aforementioned police stations and operationalizing of the PLV Scheme as aforesaid, before the next date of hearing.


Previously, while dealing with the matter, the Court had noted that there was an alarming number of about 800 juveniles or children in conflict with law who were detained in adult jails in Tihar in the past five years.

Subsequently, the Court had issued slew of directions to the Juvenile Justice Boards as well as the Delhi Government for streamlining the functioning of the juvenile justice delivery system under the Act and Juvenile Justice Rules, 2016.
