Four District Judges ordered to Retire Prematurely with immediate effect

On Thursday, the Gujarat Govt asked 4 district cadre judges to retire prematurely with immediate effect after the High Court of Gujarat recommended removing them from judicial service. In a notification issued by the state legal department, Rule-21 of the Gujarat State Judicial Service Rules, 2005 was cited to ask 4 senior judges to immediately retire from service.

It said that the High Court recommendations have been accepted to pass the order to retire them prematurely "in public interest with immediate effect". The 4 District Cadre Judges are Rajeshkumar Modi, currently an Additional District Judge in Bhavnagar; Avinash Gupta, working as Principal Judge of a Family Court in Kutch district; Additional District Judge Sangita Joshi in Morbi and Additional District Judge Amrutlal Dhamani in Anand district.

Since the retirement is with immediate effect, the legal department clarified that these judicial officers will be given "not less than three months' pay and allowances in lieu of notice period".

The reason behind the order for premature retirement of these 4 District Judges could not be known as the HC's Registrar General R K Desai did not respond despite several efforts to contact him. However, sources in the Judiciary said the HC last month decided to take action against these judicial officers looking at the low ratio of case disposal by them after a performance review.

Meanwhile, following the order for compulsory retirement for 4 senior Judges, rumours were doing rounds in legal circles that 90 judges of the subordinate judiciary have been suspended by the high court.

In May 2009, the High Court had taken action against 17 senior judicial officers of the lower judiciary and asked them to take premature retirement. They were made to go after their performance review as well as on the basis of recommendations of the vigilance department after conducting an inquiry against some Judges for alleged irregularities.
