 We are inclined to grant this freedom to the petitioner on the basis of the fact that the petitioner is an Indian manufacturer and we have earlier qualified in the claim of the petitioner in Macpower CNC Machines Limited vs. Union of India (Supreme Court) It was found that the bidders (Indian) are being discriminated against, even though the terms of the tender itself have decided that Indian manufacturers will be given preference. "Background The case of the petitioner, Bharat Fritz Werner Limited, was that he was disqualified from the tender process without assigning any reason. It was also stated that the respondent no.2 was contracted, even though the petitioner's financial bid was significantly lower than the response no.2. Counsel for the petitioner informed the court that after examining the records relating to another Division Bench of the Delhi High Court (headed by the same Judge Justice Vipin Sanghi) in the case Mac Power CNC Machine Ltd v Union of India, WP 3942/2020 Different weaknesses were found in the evaluation of different bids in the same tender and some bidders have been treated discriminately. It was argued that the petitioner is also a victim of the same illegal procedure. The Court of Inquiry noted that this dispute had merit, as already discussed in Mac Power CNC Machines (supra) and thus, granted liberty to the petitioner for appropriate civil proceedings. It also gave the petitioner the freedom to approach the PMO for appropriate action. The order stated that, "In view of the fact that the Government of India is insisting on" Make in India "(AtmaNirbharta), the complaints of the petitioner seem to be correct and in our view require serious consideration at the highest level. is." However, the Bench refused to interfere with the tender process or to grant any relief to the petitioners on the basis of principle. The Court stated that, "As seen here, the contract has already been entered into with defendant No. 2 in June 2020. In view of the fact that since the tender was tendered in favor of defendant No. 2 Sufficient time has passed, we are unwilling to interfere in it. We have therefore not gone to the defense of the petitioner's claim or the defendants. In these circumstances, even if at this stage we are unable to interfere with the tender in favor of defendant no. However, we make it clear that the way will be open for the petitioner to present all his pleas and claim relief. At this stage, proper civil proceedings are available for him.
