The Supreme Court has directed the States and Union Territories to implement the Rights of Persons with Disabilities Act, 2016 to full effect.
A Division Bench of Chief Justice DY Chandrachud and Justice P.S. Narasimha has issued notices to the States which as per the Centre's affidavit is yet to formulate rules under Section 101 and still have not constituted District Level Committee under Section 72 of the 2016 Act.
1 The affidavit filed by the Union of India indicates that the following States/Union Territories have not formulated rules under Section 101 of the Rights of Persons with Disabilities Act 2016, namely:
1 Andhra Pradesh;
2 Chattisgarh;
3 Maharashtra; and
4 Union Territory of Ladakh
2 The affidavit also indicates that the following States/Union Territories have not constituted District Level Committees under Section 72 of the Act:
1 Andhra Pradesh;
2 Kerala;
3 Union Territory of Chandigarh;
4 Union Territory of Dadar and Nagar Haveli and Daman & Diu;
5 Union Territory of Ladakh; and 6 Union Territory of Lakshadweep
The Bench had previously issued notice to the Union of India and the Ministry of Social Justice and Empowerment and directed it to file its counter-affidavit indicating state-wise implementation of the provisions of the Rights of Persons with Disabilities Act, 2016.
The Centre Government was asked to convene a meeting with all concerned states and state advisory boards with a view to eliciting the present status of compliance.
