The historic hearing on the matter of Marriage Equality/ Same-Sex Marriage continued on day three in Supreme Court.
The Chief Justice of India DY Chandrachud has significantly
remarked that by decriminalizing homosexuality, one can contemplate that
people who belong to the same-sex would be in stable marriage-like
relationships.
Here are other important observations from the third-day hearing as the court stands adjourned till Monday on the matter:
-
"We have already reached the intermediate stage that by decriminalising
homosexuality, one can contemplate that people who belong to the
same-sex would be in stable marriage-like relationships," CJI observed.
-
"In the last 69 years, our law has really evolved. When you
decriminalize homosexuality, you also realise that these are not one-off
relationships, these are also stable relationships," he noted.
-
"We see these same-sex relationships not just as physical relations but
something more of a stable, emotional relationship," Justice
Chandrachud said on the third day of the hearing by a five-judge bench
-
"Legalising same-sex marriage requires us to redefine the evolving
notion of marriage. Because is the existence of two spouses who belong
to a binary gender a necessary requirement for marriage?" he asked.
-
"There are no absolutes, as I said, even at the risk of getting
trolled. And what happens when there is a heterosexual couple and the
child sees domestic violence? Will that child grow up in a normal
atmosphere? Of a father becoming an alcoholic, coming home and thrashing
the mother every night, and asking for money for alcohol," CJI said.
-"Just
in the case of heterosexual couples, now with the spread of education,
the pressures of the modern age, increasingly, couples are either
childless or single child couples... People are moving away from the
notion that you must have a boy," CJI observed while responding to
arguments about the impact of same-sex marriages on children.
