The Single Judge Bench of the Punjab and Haryana High Court , comprising Justice Alok Jain in the case of Varun Bagga v. State of Punjab has imposed fine of Rs 1 Lakh on complainant for filing false FIR and misusing the process the law .
Reasoning and Decision of the Court
The Court was informed that the parties have amicably settled their dispute, and continuance of criminal prosecution in such a situation will be an exercise in futility, as the chances of ultimate conviction are bleak.
The Court exercised the power under Section 482 Cr.P.C. and quashed the matter and paid reliance to the judgment of Gian Singh v. State of Punjab and another.
The Court further observed that the present petition demonstrates that how the process of law is abused just for the whims and fancies of the person like the complainant, who first slapped the petitioner in full public place and then just to suffice her ego, lodged the present FIR and then has compromised the matter.
The Court expounded that it is the tax payer money which has been wasted on account of the false FIR lodged by the complainant and considering the mala fide intentions of Complainant, imposed the cost of Rs. 1,00,000/-, which is to be paid within one month.
