The Single Judge Bench of the Punjab&Haryana High Court, comprising Justice N S Shekhawat in the case of Imaan Singh Khara Vs State of Punjab and others has issued notice to the State Government on a habeas corpus plea regarding detaining of Amritpal Singh without disclosing any reasons and grounds of his arrest.
The advocate appearing on the behalf of the petitioner submitted that the alleged detenue, namely, Amritpal Singh is the head of an organization “Waris Punjab De”, which was formed to fight for social justice and preserve the rights and culture of Punjab. He contended that Central Para Military Forces illegally and forcibly detained the alleged detenue, without disclosing any reasons and even he was not informed about the grounds of his arrest. Further, the alleged detenue has been detained for the last more than 24 hours and the respondents are not disclosing anything about his whereabouts.
Learned counsel also contended that the petitioner had approached all the concerned authorities for release of alleged detenue, but no heed was paid to his repeated requests.
Therefore, the Court issued notice to the Government of Punjab and Ms. Anu Pal, Senior DAG, Punjab, accepted notice on behalf of the respondents and prayed for time to file a detailed reply by way of affidavit of the concerned Commissioner of Police on the date fixed before this Court.
