SC refuses to entertain bail pleas of Advocates arrested for vandalism in HC premises

 

The Supreme Court has refused to entertain bail applications of Advocates who indulged in vandalism in Orissa High Court premises during strike demanding formation of new Benches in the State.

The Division Bench of Justice S.K. Kaul and Justice A.S. Oka while remarking the Apex Court is not a bail court has advised the petitioners to take the issue to High Court.

The Counsel for Central Action Committee (CAC) of all Bar Associations of Western Odisha has submitted that about 30 Advocates, including 4 women, are behind the bars since the past 45 days.

He apprised the Bench that the District Court has already denied bail to the Advocates and the applications now lie before the Odisha High Court which he claimed has deferred the hearing on several occasions.

In December 2022, the strike in Sambalpur took ugly turn when the Advocates along with the local public resorted to vandalism in the Court premises. This prompted the Supreme Court to pass direction to State Government to take stringent action against the striking Advocates. Resultantly, apart from Bar Council suspending the license of the Advocates who participated, arrests were also made and cases were also lodged.

The Supreme Court has openly criticised the conduct of the Advocates as disgrace to the profession. It didn't mice words in reminding the Advocates that their duty is to assist the Court in imparting justice and not hinder the cause. 

“We must impress upon the legal fraternity that the privilege to have a license of a lawyer is to use it responsibly...The disruption of normal functioning affects the litigants. We are saying so in the general context not with respect to the incident...."
