The Top Court today rejected a petition made by NIA requesting cancellation of bail granted to activist Anand Teltumbde, accused in Bhima Koregaon case.
The top court bench led by CJI and composed of other judge Hima Kohli rejected the plea to involve the Bombay HC order.
HC gave the bail to Teltumbde and rejected the plea filed by NIA.
But, the Supreme Court of India court said the observation of the high court shall not be treated as conclusive final findings at the trial.
Senior lawyer kapil Sibal, appearing for the teltumbde, contended before the court that the HC has already dealt with the issue and they showed to it that there is no evidence against him.
He added that the high court applied its mind and granted him bail and added that "until and unless there is something perverse your lordships do not interfere with bail".m
Sibal said his client was not even at the Elgar Parishad event and the NIA has not shown anything to show that he was there, and added that the high court says there is no document to connect him with terrorist activity.
Granting him bail of Rs 100,000 plus two sureties, the division bench noted that prima facie, UAPA sections for offences of unlawful activities, terrorist acts and conspiracy were not made out, though membership and support to a terror group was made out.
