The accused in the alleged human sacrifice case of Elanthoor have approached the Kerala High Court challenging a Magistrate Court’s order sending them to 12 days of police custody.
In the petition, Muhammed Shafi, Bhagaval Singh and Laila –– the first, second & third accused –– have contended that it is to create fake evidence in accordance with the false stories being propagated by police & to force them to give evidence against themselves that the investigation team has obtained their custody for such a long period.
While considering the police’s plea for custody, the magistrate court did not properly ascertain the facts & granted custody based on the false information provided by the Police, it is alleged.
The accused also contend that they have not been provided adequate legal aid or opportunity to consult a lawyer. In addition to leaking information regarding their confessions & statements of witnesses, police are spreading false stories too, the plea said.
Such long custody is to force them to create false evidence & to parade them in front of the public & media, the petition said. The magistrate court did not consider these while granting the long custody, the petition said.
