SC agrees to hear pleas challenging the Centre's Agnipath scheme next week

The Supreme Court decided to hear petitions challenging the Central Government's Agnipath initiative to induct youth into the three-armed services divisions next week, subject to the Chief Justice's permission.

When the Supreme Court reopens after the summer break, applications will be heard by an appropriate bench, according to a vacation bench of Justices Indira Banerjee and JK Maheshwari.

The counsel for the armed forces aspirants requested an early hearing on the matter and stressed that the scheme should not be extended to those who are currently in the selection process. She further claimed that the subject was urgent since the careers of several hopefuls were at risk and that the scheme's implementation would reduce the aspirants' tenure from 20 years to four years. The counsel stated that despite many mentions, the register has not provided a definite date and urged the Supreme Court to do so. 

 

Advocate M.L. Sharma also mentioned his request to the Supreme Court to dismiss the notification issued by the Ministry of Defence launching the plan on June 14, 2022. Sharma stated that the government can implement any policy, but it is all about right and wrong. He also stated that around 70,000 people are still waiting for appointment letters.

After hearing the contentions, the vacation bench said: “List it before the appropriate bench after reopening”.

Sharma claims in his PIL that the government has terminated the century-old selection procedure for the Armed Forces, which is in violation of the Constitution. The Agnipath scheme, launched on June 14, calls for the recruitment of young people aged 17 and a half to 21 for only four years, with the option of retaining 25% of them for another 15 years. Protests against the idea have erupted in various states.

Later, the government raised the upper age limit for recruitment to 23 years old in 2022.

The petition also mentioned nationwide protests against the scheme. Earlier, multiple petitions were filed in the Supreme Court, requesting that a Special Investigation Team (SIT) be formed to investigate the damage to public property, including that of railways, during violent protests against the scheme. 

Another petition was filed by counsel Vishal Tiwari, who requested that a committee be formed to investigate the scheme and its impact on national security and the Army. The Central Government has filed a caveat in the Supreme Court on the petitions related to the 'Agnipath' scheme, requesting that the court hear it before making any judgement.
