Taking voice sample doesn’t make Accused a Witness: Court

A Delhi Court has observed that taking voice sample of an accused does not make him a witness against himself.

The observations came while allowing the police’s appeal seeking a voice sample of Jamia student leader Meeran Haider in a northeast Delhi riots case.

“The aspect of taking voice sample of an accused is an aspect of investigation,” Additional Sessions Judge Amitabh Rawat said in the order.

The Court further noted that Haider was arrested in the case that related to large scale & deep-rooted conspiracy leading to the riots in Delhi & further investigation was in progress.

The prosecution had moved the application for taking voice samples of Haider so that certain data/incriminating audio files, which were found retrieved by CERT-In from the mobile phone of co-accused Asif Iqbal Tanha, may be matched with his voice.


The Court directed the investigating officer (IO) to coordinate with CFSL, CBI, New Delhi & fix a time & date for obtaining voice samples of Haider & inform the court about the same so that production warrants of the accused can be issued.
