Court rejects Bail of accused making false documents

On Tuesday, Additional Sessions Judge Kanpur Nagar Vikas Goel rejected the bail plea of accused Gaurav Mishra, who was arrested by the police for committing the offence of cheating, making false documents & criminal conspiracy & also under the Copyright Act.

The Court stated in its order that accused Gaurav had been charged for manufacturing duplicate ayurvedic medicines by making forged labels of medicine & selling the same in the market. Since the charges were of serious nature, & keeping in mind all facts & circumstances of the case & the seriousness of the offence, the court found that the bail application of the accused was liable to be rejected, the court stated in its order.

According to additional district government counsel (ADGC) Sanjay Sahu, the complainant in his FIR stated he had got information that some people were manufacturing & selling duplicates of his herbal product. When he cross-checked online through apps, he found that a Kanpur-based firm in his name was manufacturing & selling duplicate medicines, he stated in the FIR.

The firm through a writ petition filed in the high court requested it to order the police to conduct a raid. Later, the Govind Nagar police conducted the raid & arrested Gaurav Mishra on February 4, 2022.
During the raid, police found that a duplicate firm was being operated, & seized a huge quantity of labels of the original firm from the factory premises. The factory workers told the police that the factory was being run by Priyanshu Kumar Singh Chauhan, his wife Seema Singh and manager Gaurav Mishra.

The duplicate medicine was being manufactured making light changes to its formula & after duplicate packing. During the investigation, police say that Priyanshu, Seema Singh & Gaurav were involved in this illegal trade. Priyanshu told the police that his wife Seema Singh was working in Gopal Herbal Company in Faridabad where the original medicine was manufactured, the ADGC said.Since Seema knew the medicine formula therefore all the three were involved in making the duplicate product with some changes made in the formula, the ADGC, further said. Earlier, accused Gaurav Mishra in his bail application had claimed that was not aware that any duplicate medicine was being manufactured because he was not the manager but just an employee of the factory. Priyanshu & Seema Singh were the owners, manufacturers & managers of the firm. Since he was named in the FIR, therefore he should be released on bail.
