A Single Judge Bench of the Kerala High Court comprising Justice Raja Vijayaraghvan has issued notice to the State Government and instructed the Government pleader to look into the question of whether keeping birds as pet amounts to a violation of any provision of law.
The Bench held that,
“There will be a direction to respondent Nos.2 and 3 to refrain from insisting that the petitioner shall remove the birds from the terrace of his residence for the time being.”
Background of the Case
The petition feed birds on his terrace. The grievance of the petitioner is that he and his family members are being subjected to harassment by respondents for keeping pet birds in their residence.
Aggrieved by the harassment, the Petitioner filed a petition in the High Court to sought relief and refrain respondents from harassing him.
Reasoning and Decision of the Court
The Court considered the grievance of the Petitioner and directed the Respondents to not harass the petitioner and his family in near future. The Court held that,
“There will be a direction to respondent Nos.2 and 3 to refrain from insisting that the petitioner shall remove the birds from the terrace of his residence for the time being.”
The Court also instructed the Government Pleader to get instructions and report whether the petitioner has been violating any provision of law by keeping birds as pets. Therefore, the Court posted the matter after a week.
