VVIP Augusta Westland Chopper Scam case: SC refuses to cancel bail granted to Rajeev Saxena

 

The Supreme Court (SC) refused to cancel the bail granted by the Delhi High Court to Rajeev Saxena, accused-turned-approver in the VVIP Augusta Westland Chopper Scam on January 16, 2024. The Central Bureau of Investigation (CID) filed a plea seeking the cancellation of bail granted to Rajeev Saxena whereas the SC refused to entertain the same. The SC bench comprising Chief Justice of India DY Chnadrachud, Justice Manoj Misra, and Justice J.B. Pardiwala granted liberty to the CBU to move an application for the same before the Trial Court. In the Chargesheet field by the ED, a director of two Dubai-based firms (UHY Saxena and Matrix Holdings), Rajeev Saxena is one of the accused. 

During the Court proceedings, Additional Solicitor General SV Raju, appearing for the CBI, contended that “He (Saxena) is not co-operating, he’s not giving us documents, he’s not answering questions, not coming to us when we are calling him…I am not pressing for consolation, my entire endeavor is to show that he is not cooperating, let there be a condition/direction that he should cooperate, he should come when we call for, he doesn’t come, he doesn’t comply with the summons.” Hearing this, the CJI remarked, “It’s not that the original order was granted only on the grounds of medical conditions, it is also recorded that he has cooperated.” The bench therefore refused to interfere with the order of the Delhi HC and dismissed the application of cancelation bail.
