Police inaction against noise pollution: High Court seeks DCP's presence

Development of jurisprudence in ancient India - iPleaders

The High Court of Bombay directed the Deputy Commissioner of Police (DCP) (zone XII) to remain present on Wednesday while hearing a plea by a lawyer regarding police inaction against noise pollution from a mosque at Thakur village, Kandivli (east).

A bench led by Justice Revati Mohite-Dere heard a petition by Reena Richard who made several complaints to Samta Nagar police station & even posted live videos on Twitter to show that the mosque is using loudspeakers during early hours.

Her petition said there is an ESIS Hospital nearby. Richard had filed a petition in 2017 to stop the noise. In 2018 after she filed a contempt petition, the loudspeakers were removed. Her petition said in May 2022 the loudspeakers were back.

On Tuesday, the police submitted a report that the distance between the hospital & mosque is 90 metres, which is within the 100 metres criteria of silence zone under Noise Pollution Rules. After perusing the report, the judges sought the zonal DCP's presence.
