Defamation: Gujarat HC refuses to stay Rahul Gandhi's Conviction, to decide matter after vacation

The Gujarat High Court on Tuesday heard the plea filed by Congress leader Rahul Gandhi seeking a stay on his conviction in a 2019 criminal defamation case over his “Modi surname” remark. The Gujarat High Court will give the verdict after the summer vacation is over.

In March, Rahul Gandhi was convicted in the 2019 defamation case and was sentenced to two years in jail by a Surat court. Following this conviction, Rahul Gandhi was disqualified as a Member of Parliament.

Rahul Gandhi has approached the Gujarat High Court over the Surat court's decision. The Gujarat High Court on Tuesday denied interim protection to Rahul Gandhi. The court said it will deliver its verdict post vacation, in June.

Senior advocate Abhishek Manu Singhvi, appearing on behalf of Rahul Gandhi had argued, “I have seen this one as the first ever case wherein maximum punishment is imposed for criminal defamation.”

Singhvi sought the court's decision on the plea today. However, the court of Justice Hemant Prachchhak said, "It is in the interest and fitness of the case, that the matter be decided finally and no interim protection be granted at this stage. Hence, the matter is kept for final judgment post summer vacations."

 

RAHUL GANDHI'S CONVICTION IN DEFAMATION CASE

On March 23, a Surat court sentenced Rahul Gandhi, who represented Wayanad parliamentary constituency in Kerala, to two years in jail after convicting him under sections 499 and 500 of the Indian Penal Code for criminal defamation. The defamation case was filed over Rahul Gandhi's “how come all thieves have Modi as the common surname?” remark made during an election rally at Kolar in Karnataka in 2019.

Following his conviction, Rahul Gandhi was disqualified from Parliament.

On April 3, Rahul Gandhi's lawyer approached the sessions court with two applications, one for bail and another for a stay on conviction pending his appeal, along with his main appeal against the lower court’s order sentencing him to two years in jail. While the court granted Gandhi bail, it rejected his plea for a stay on conviction. 

 

Rahul Gandhi then filed a plea in Gujarat High Court, challenging the order of a Surat sessions court declining a stay on his conviction in the criminal defamation case.
