The Allahabad High Court has sought Centre and State Government's reply as to how on Government expense or the funding provided by the Government Exchequer religious education be imparted and whether this could be in violation of Articles 14, 25, 26, 29 and 30 of the Constitution of India.
The Court was adjudicating on petition filed by on teacher of Madarsa pertaining to some salary dispute seeking various relief.
Noting that in Madarsa besides normal curriculum, the religious education is also imparted, the Court sought a response from the authorities within six-weeks.
"Let the Central Government and State Government file their affidavits explaining that how on Government expense or the funding provided by the Government Exchequer religious education be imparted and whether this could be in violation of Articles 14, 25, 26, 29 and 30 of the Constitution of India," the order reads.
In the meantime, the salary of the petitioner be paid in terms of the contract, it ordered.
