On Tuesday, the Delhi High Court refused to entertain petition filed by BJP's Ashwini Upadhyay seeking direction to Law Commission to make a report on 'Uniform Judicial Code' to make legal terms, abbreviations, case registration processes, and other aspects of the legal system uniform across the country.
A Division Bench of Chief Justice Satish Chandra Sharma and Justice Yashwant Varma observed that Supreme Court via its September 2022 order has already dismissed the petition seeking similar relief filed by the petitioner and no liberty was granted to approach High Court.
The Court noted that the petitioner has to obtain clarification from the Supreme Court if he wants to pursue the petition via High Court as in absence of Top Court's liberty, it cannot dwell into the issue.
Upadhyay stated that it would be difficult for him to do that as it was a general order passed by the Former CJI, UU Lalit. The Court even declined to consider the chart prepared by him on the issue. He eventually withdrew the petition.
