The Central Government has filed a fresh affidavit in the Supreme Court amid the ongoing hearing on marriage equality seeking to make all States and Union Territories parties to the case.
The new affidavit has been filed on the premises that the present case involves the legislative rights of the States under the Seventh Schedule of the Constitution and the rights of the residents of the States.
It has been submitted that further, various States have already legislated on the subject through delegated legislations, therefore making them a necessary and proper party to be heard in the present case.
Stating that the issue goes to the root of the present matter and has far-reaching implications, the affidavit urges that all States and UTs be made parties to the case as otherwise, any decision would render the present adversarial exercise incomplete and truncated.
The affidavit has been filed by Joint Secretary and Legislative Counsel KR Saji Kumar.
