The Single Judge Bench of the Punjab and Haryana High Court, comprising Justice Vinod S Bhardwaj in the case of Anahita Handa v State of Haryana & Ors has issued a stay order on the ban imposed by the state government on the sale and purchase of meat and meat products in the area around the Mata Mansa Devi temple in Haryana.
The Additional Chief Secretary to the Government of Haryana in a notification had demarcated area near the Mata Mansa Devi temple as a "Holy Area", and as a result, the slaughtering, sale, and purchase of meat and meat products were prohibited in the area.
The learned senior counsel appearing for the petitioners contended that respondents-State of Haryana, does not refer to any statutory provision in exercise whereof such a declaration has been issued. He further contends that the petitioners were duly issued their licences by the competent-Authority to deal in the sale and purchase of meat and meat products in the said area and that they undertake to carry out business as per law.
The Court considered the submission of the Petitioner and issued notice to the Respondent State and ordered that operation of the impugned Notification dated 21.12.2022 shall remain stayed till the next date of hearing.
The Court listed the matter on 07.08.2023 for next hearing.
