High Court asks State to disclose tstatus of Lokayukta Institution and expenditure incurred on it since its inception

The Division Bench of the Uttrakhand High Court, comprising Chief Justice Vipin Sanghi and Justice Alok Kumar Verma in the case of Ravi Shankar Joshi v. State of Uttarakhand has directed the State to provide information on the status of the establishment of the Lokayukta Institution and the expenditure incurred on the said institution since its inception, year-wise up to 31st March 2023, within three weeks.

The petitioner has filed writ petition to seek a direction to the respondent State for establishment of the Lokayukta Institution and enforcement of the Lokayukta Act, 2014, and to make appointment of the Chairman / Members of the Lokayukta Institution.

The Counsel of the Petitioner also emphasized that the respondents should be directed to file the latest report with regard to enforcement of the aforesaid Act as the State is reportedly spending crores of rupees every year without the Institution of Lokayukta being operational.

The petitioner has filed writ petition in public interest to seek several directions for compliance of the Water (Prevention of Control of Pollution) Act, the Environment (Protection) Act, 1986, and the Rules framed thereunder, in relation to Biomedical Waste Management, Construction and Demolition Waste Management, E-waste (Management), and the Hazardous and other Wastes (Management and Transboundary Movement).

The Bench considered the submission of the Petitioner and direct the respondents to file an additional affidavit disclosing the status with regard to establishment of the Lokayukta Institution.

 

The Court listed the matter on 08.05.2023.
