The Delhi High Court has set aside the Delhi University's decision to debar NSUI (Congress's Student Wing) Secretary for alleged involvement in screening of a recent controversial BBC Documentary on PM Narendra Modi, ‘India: The Modi Question’ investigating role of the then CM in the infamous 2002 Gujarat Riots.
Lokesh Chug, a Ph.D. research scholar at the Department of Anthropology at Delhi University was debarred from appearing in any university/college/departmental examination for a period of one year on premises that he masterminded the screening which amounted to indiscipline on his part.
The single-judge bench of Justice Purushaindra Kumar Kaurav has now quashed the decision for “violation of natural justice” and restored Chugh’s admission to the varsity.
He had previously remarked that University’s order doesn't reflect the application of mind.
“There has to be independent application of mind which is not reflected in the order… The order must reflect the reasoning,” he said.
Chug has challenged the memorandum issued by the office of the varsity’s Registrar directing his debarment. He also challenged the show cause notice issued by the office of the Proctor which held that he was involved in a disturbance of law and order in the university during the screening of the documentary.
The issue stems from protests organized in DU Campus in light of censorship of the documentary by the Centre. While Chug claimed that he was not present at the protests and was instead at a media interaction, the University provided a contrary version.
Senior Advocate Kapil Sibal and Advocate Abhik Chimni appeared for the petitioner.
