HC seeks BCI, Govt's response on protection of Lawyers, may issue guidelines

Shocked at laxity, indifference of government: Rajasthan High Court directs  disbursal of grant-in-aid to children's shelter home

The Rajasthan High Court has sought responses of Central Government, State Government, and the Bar Council of India (BCI) on protection of advocates from violence, harassment, and threats etc.

The Court is inclined to issue guidelines on the same as it dealt with petition pending since 2020 seeking framing of an appropriate legislation for the protection of advocates.

 

Acting Chief Justice Manindra Mohan Shrivastava and Justice Anil Kumar Upman took cognizance of the recent incident wherein a Lawyer was murdered in broad day light on his way back to home. This triggered the State Lawyers who went on to state protests demanding steps be taken for their protection.

The Court has remarked that ever since the petition has been filed, the State drafted a Bill to address the issue. The Court was also apprised by the Additional Advocate General that the matter was going to be considered at the top executive level soon.

It was also informed that BCI too has taken initiative and drafted a Bill with aim to protect the Advocates and has forwarded the same to the Law Ministry.

 

Noting that neither of the Bill has been enacted, the Court opined that the grievance has been taken up but not yet acted on.

"We, thus, find that though the grievance of the Members of the Bar has been taken up for consideration at different level, but till date no legislation has come," the Court observed.

In this backdrop, the Counsel for petitioner urged the Court to frame guidelines in the matter until the legislature acts.

 

Therefore, the Court sought the resoponse of Governments and BCI in the aspect. It also impleaded the Bar Council of India.

"The Bar Council of India may also come out with appropriate suggestions in the matter towards framing of guidelines," the Court said.
