The High Court of Jammu & Kashmir and Ladakh has notified 'Live Streaming and Recording of Court Proceedings Rules of the High Court of Jammu & Kashmir and Ladakh, 2023' to govern and streamline the live streaming and recording of proceedings of cases in courts and tribunals in the Union Territories.
The Registrar General, Shahzad Azeem published the Rules on Monday stating that they will apply to the High Court of Jammu & Kashmir and Ladakh and to the courts and tribunals over which it has supervisory jurisdiction.
It has been stated in the rules that a dedicated control room (DCR) shall be set up for every court complex comprising of an officer of the Court, technical and video- recording experts to monitor and track proceedings as they are live streamed, recorded, and transcribed. The DCR shall ensure that nothing uncivil or inappropriate is streamed in the public domain.
Rule 5 contains the list of the cases that shall be excluded from Live Streaming. It contains names of matters pertaining to matrimony, child adoption, child custody, sexual offences, gender-based violence against women, POCSO Act, Juvenile Justice Act etc.
It has also been clarified that Live streaming in certain cases may be restricted to final arguments. Objections, if any, to Live streaming may be raised at the time of institution of the case or any later stage. The final decision in that behalf shall be of the Bench.
In cases where the proceedings are not live streamed, the recording shall be maintained for usage by the Court and the appellate court(s) subject to conditions as prescribed.
