On Wednesday, the Chief Justice of India DY Chandrachud came to the defence of the SC Registry after it was pointed out that a matter was listed before another bench, in violation of rules.
CJI Chandrachud made the observation when Lawyer Prashant Bhushan mentioned a contempt plea in the Tamil Nadu cash-for-jobs scam case.
Sr Lawyer Dushyant Dave explained that the matter was to be listed before Justice Krishna Murari, but was assigned to another bench.
The senior advocate added that "Registry needs to follow rules".
At this point, CJI said, "It is very easy to criticize the Registry, but I have to take a look at the papers & then take a call."
Solicitor General for India Tushar Mehta then weighed in, saying that the decision to list cases lies with the Chief Justice of India as master of roster, & all parties involved are obligated to accept the decision.
Senior Advocate Dushyant Dave then clarified, "I am a judges son & I have great faith in the judiciary & my criticism is always objective & not subjective. Please do not misunderstand."
However, CJI Chandrachud remarked, "It is very easy for you to criticize anyone under the Sun, but let me take a look at the papers in the evening."
Senior Lawyer Gopal Sankaranarayanan then pointed out that the case was previously dealt with by a bench of Justice V Ramasubramanian, which is why it was listed again before him.
Senior Lawyer Kapil Sibal opined that such matters should not even be discussed before the Court.
