The arrest of aerospace scientist Nambi Narayanan in the infamous Isro spy case of 1994 was illegal as the premise that scientific information had been leaked was itself concocted, the CBI told the Kerala high court Friday while making a case for denying anticipatory bail to those being probed for the alleged frame-up.
The pre-arrest bail pleas of those being probed by the agency were being heard afresh on SC's instructions.
CBI said it would produce the case diary on Tuesday to back up its theory that Nambi's arrest was part of an alleged international conspiracy to frame Isro scientists in a spy case. Custodial interrogation of the accused in the frame-up is necessary and, hence, they shouldn't be granted anticipatory bail, the agency argued.
