HC grants bail to man arrested for posting objectional material against CM Yogi

 

The Allahabad High Court has granted bail to man accused of posting allegedly objectionable material against Uttar Pradesh CM Yogi Adityanath on Facebook.

The single-judge bench of Justice Sameer Jain observed that the offences under which the accused has been challaned (Sections 295A, 505 (2) I.P.C. and Section 67 of the Information Technology Act) have maximum punishment of three years and the that he is in jail for about more than three months as the arrest was made in September 2022.

The Court additionally noted that the accused has no criminal history and offences charged in the present case are triable by Magistrate-Ist Class.

The petitioner has argued that he is innocent and has been falsely implicated in the case and bring in highlight the nature of the case.
