This suit revolved around the Trademark Infringement of Louis Vuitton Malletier by the Defendant company through its portal Club Factory (www.clubfactory.com).

Procedural History

Vide previous order dated 2^nd August 2022, this matter had been listed for ex-parte evidence in respect of the relief of damages. However, owing to certain sensitivity, the Plaintiff only wished to press for costs in this matter and did not wish to press for damages, though, the suit was decreed on 24^th March 2022, wherein a permanent injunction was granted restraining the Defendants from, in any manner, manufacturing, selling, offering for sale directly or indirectly any goods including face masks etc., bearing the following registered marks of Louis Vuitton on its portal www.clubfactory.com or any other portal run by the Defendants. 

Observations by the Court

The Bench noted that the bill of costs placed on record under signatures of ld. counsel for the Plaintiff showed that the total cost being claimed was Rs.32,29,416/-.

Judgment ; 

Considering the facts of this case, costs of Rs.20,00,000/- were awarded in favour of the Plaintiffs. No other reliefs were pressed by the Plaintiff.
