The Supreme Court has come to rescue of a father invested in search of his missing son from past 17 years and directed the Madhya Pradesh Government to handover the case to Special Investigation Team (SIT).
Notably, the missing minor son of the petitioner at one point of time made accused in case pertaining to outraging the modesty of a woman and in relation to this, FIR was registered against him under offences of Sections 354, 506, 294 of IPC.
The petitioner previously had filed a Habeas Corpus Petition before the High Court which came to be dismissed.
The Court observed that although the State Government is filing status report on every hearing, there is a feeling it is only paper compliance and nothing positive is coming forward.
The Court didn't appreciate the manner of search by the Police considering the child was missing for such a long duration.
"The last status report which has been placed for perusal is also of paper compliance indicating that search warrants have been issued in neighbouring villages but nothing has come forward. Obviously, nothing will come forward for the reason that this minor son is not traceable for more than 17 years. The question of his availability in nearby villages does not ordinarily arise."
It thus directed formation of SIT headed by Inspector General of Police.
