HC grants interim bail to petitioner to pay his daughter’s LLB admission fees, opines ‘family should not suffer for his acts’

The Single Bench of the Delhi High Court in the case of Nihal Ahmed vs State (GNCD) consisting of Justice Talwant Singh granted interim bail to petitioner to pay his daughter’s LLB admission fees while opining that “family should not suffer for his acts”.

Facts

This Bail Application was filed by the petitioner to plan for making payment of admission fees for LLB course to be pursued by the daughter as he has been in judicial custody for the last about 9 months.

Status Report was handed over in Court and the same was taken on record. The factum regarding admission of the daughter of the petitioner was verified. It was submitted that the last date for payment of admission fees is 15.11.2022. The charge-sheet was filed.

Contentions Made 


Respondent: It was contended that the petitioner had been declared a proclaimed offender in this case and thereafter, he was arrested and moreover, he was involved in another case also.

Order

The Bench, keeping in view the fact and circumstances of this case and opining that the family should not suffer for his acts , granted him interim bail for a period of ten days from the date of his release, on execution of personal bond of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned court on conditions that he shall share his mobile number with the IO within one day of his release and keep the mobile location app on at all times, shall not try to contact, coerce or threaten the witnesses in this case, shall appear before the Court when his case is listed during this period and surrender on the expiry of the period.
