On Tuesday, the Delhi High Court has deferred the matter mounting challenges to certain provisions of the Assisted Reproductive Technology (Regulation) Act, 2021 and the Surrogacy (Regulation) Act, 2021 to 14th April, 2023.
The Bench comprising of Chief Justice Satish Chandra Sharma and Justice Subramanium Prasad was apprised by the Respondent-Centre that similar challenge is pending in the Hon'ble Supreme Court as well.
The Court thus decided to post the matter for next year.
The Centre has maintained its stand that the Acts were enacted following due procedure, with an intention to restrict the commercialisation of embryos and new-born children.
In the affidavit filed, the Centre had contended that the law was passed by Parliament after receiving comments from all the stakeholders and the provisions challenged by the petitioners regulate the procedure of assisted reproductive technology (ART) and surrogacy, which, if diluted, would defeat the whole purpose of the law.
