On Wednesday, the High Court of Patna warned the state police for not lodging an FIR against the cops who allegedly manhandled a lawyer & abused his colleagues at Shastri Nagar police station in Patna.
The division bench of Justice Rajan Gupta & Justice Mohit Kumar Shah, while hearing a Public Interest Litigation, granted "last opportunity" to Patna police for initiating criminal proceedings against the erring cops & submit an action taken report (ATR) within a week.
The plea has been instituted suo motu upon the complaints made on behalf of the Bar before the HC regarding the alleged thrashing of a lawyer who had accompanied his client Abhishek Kumar to the police station on Aug 3 to know the reason why he was asked to be present in the police station without any prior notice. The victim's lawyer, Saket Gupta, was allegedly abused by sub-inspector (SI) Smita Sinha & thrashed by SI Lal Bahadur Yadav when Abhishek was allegedly detained for no reason. Saket had made an online complaint to the DGP but in vain as no police case was instituted against the accused cops. On the contrary an FIR was instituted against the victim lawyer .
Taking serious note of the matter, the division bench on Aug 4 directed the DGP to get the matter enquired & take appropriate action. The Court had appointed advocate Gautam Kejariwal as amicus curiae.
On Wednesday, Justice Gupta orally asked why the police department was shying away from taking action against its own erring employees?
State counsel Prabhu Narain Sharma apprised the court that the departmental had initiated action against SI Yadav.
The HC also directed for stay of the criminal proceedings set in motion after the institution of an FIR against Saket. This matter will be next heard on Sept 12.
