HC: Police inaction in Minor's Rape and Murder is height of absurdity and stupidity,

The Madhya Pradesh High Court was taken a back by the Police's inaction in tracing an 11-year-old missing minor girl from past 5 years as her father approached the Court back in 2017.

The Division Bench comprising of Justice Rohit Arya and Justice Milind Ramesh Phadke observed that depite 3 SITs set up fot the task, the case made no progress and that shows the incompetence of Police Officials.

The Counsel for the petitioner contended that at some point of time, though there was a breakthrough situation during investigation with the incriminating material found, still the investigation was put to a standstil.

 

The Court remarked at the outset that despite repeated orders by this Court, callousness on the part of the Police force is well evident.

It also cited failure to investigate the suspect and examined the photographic evidence which shows how brutally she was treated.

 

"The height of absurdity and stupidity on the part of the Police officials is writ large, as despite the said knowledge of demise of the corpus, subsequent reports are being submitted that the missing corpus Ms. Geeta is being searched."

The Court noted that although the Police's affidavit is comprehensive but prima facie the same appears to be a lip service, as no substantial steps have been taken for action against such assailant, who was alleged to have stated about the rape and murder of the deceased missing corpus.

It was also astonished at the fact that so far, no FIR has been lodged to start the investigation on aforesaid disclosure of the fact of the death of the deceased corpus. 

The NARCO Test application still pending shows the insensitivity and indifference of said official in such heinous crime and renders his conduct vulnerable, the Court observed.

"We are constrained to observe so, despite repeated orders by this Court, DG Police Madhya Pradesh since the year 2020 has maintained blissful silence for the reasons best known to him. We may hasten to add that complaints of inaction or polluted action by the police force are invariably brought to the notice of this Court in different jurisdiction. We take strong exception to the functioning of the Police force in the State particularly, in the Guna district relevant to the facts of this case."

Stating that safety and protection of public at large against invasion on their personal liberty and property appears to be seriously jeopardized, the Court noted that in the present case, "Âœthere is no one to Police the Police Man in this State"Â.

 The Court called upon Inspector General of Police to appear before it and also cited possibility of calling in DG Police.
