Supreme Court takes up Plea to Stop Attacks against Christians

On July 11, the Supreme Court will hear a petition calling for an end to "targeted hate speech" targeting Christians and attacks on places of worship.

Law- What is and What ought to be?

The petition was brought before a bench of Justices Surya Kant and JB Pardiwala by Archbishop of Bangalore Diocese Dr. Peter Machado, the National Solidarity Forum, and the Evangelical Fellowship of India.

The petition requested orders to stop violence and mob attacks on members of the Christian community in several states around the country, as well as the enforcement of previous Supreme Court instructions to combat hate crimes.

The appeal requested the implementation of the recommendations set in the Tehseen Poonawala judgement, which called for the appointment of nodal officials to take note of hate crimes and lodge FIRs across the country.

The Supreme Court issued a series of directions in 2018 for the Centre and State governments to control and prevent the rising incidence of hate crimes, like as mob violence and lynching.

According to the Supreme Court, Fast-tracked trials, victim compensation, deterrent punishment, and disciplinary action against law-enforcement authorities were all part of the rules. Hate crimes, cow vigilantism, and lynchings, should be prosecuted. (ANI)

“In May, 57 cases of violence happened and more attacks are anticipated,” said Senior advocate Colin Gonsalves, appearing for the petitioners.

“It is unfortunate if what he (lawyer Colin Gonsalves) is saying is right but we can't say more on the merit of the plea. List for hearing on July 11,” said the Supreme Court.

The petitioners have stated that they are protesting "sinister phenomena of violence" and "targeted hate speech" directed at the country's Christian community by vigilante groups and members of right-wing organisations.

It also claims that the central and state governments, as well as other state authorities, have failed to take immediate and necessary action against groups that have perpetrated widespread violence and hate speech against the Christian community, including attacks on their places of worship and other institutions.

“What you are saying is unfortunate, if it is happening. What we can ensure is that your matter is listed on the re-opening day itself,” stated the bench.
