Plea asks High Court to direct ‘Ministers on unofficial leave to return’

Seven persons, residents of Pune, Mumbai & Buldhana, have approached the High Court of Bombay with a Public Interest Litigation alleging their fundamental rights are affected & seeking directions to ‘rebel’ Shiv Sena MLA Eknath Shinde “who is on unofficial leave with other Ministers to return & assume duties.” On Monday, their counsels Asim Sarode & Ajinkya Udane sought an urgent hearing date before the High Court bench of Chief Justice Dipankar Datta and Justice M S Karnik. The High Court said it would see the praecipe—their written application for urgent hearing—and see then about setting a date.

The plea filed by Pune resident Utpal Chandawar & others–including writers, a law student, & lawyers—against Shinde, state of Maharashtra through its secretary (general administration), Sena president, NCP president (Maharashtra) & INC president alleged that “public rights” of citizens were getting affected due to the political “turmoil”. It claimed there was “public nuisance to the citizens” as Ministers are neglecting their duties to the people who have elected them. It said High Court can expand the definition of ‘public nuisance’ to bring the “neglect” by elected MLAs under its ambit. The PIL sought orders to also direct action be taken on Shinde & others for “omission of duties & moral wrongs committed leading to disrespect towards public rights.” - Swati Deshpande
