In an interesting instance, the Chief Justice Pankaj Mithal of J&K and Ladakh High Court has issued circular restricting judicial officers of the subordinate courts from receiving, seeing off, arranging trips, hotels, food or offering gifts to visiting Chief Justice/High Court Judges who may have come to a particular subordinate court.
The Circular states that the same shall be done by a senior non-judicial Administrative Officer. He/ She shall only be allowed to receive and see-off and shall provide protocol services to them as per norm.
It has also been mentioned that if the visiting Chief Justice/High Court Judge wants to conduct a meeting with the Judicial Officers, the same shall be done either before or after court hours.
The same shall apply if they want to call a particular Judicial Officer.
The Circular also bars Judicial officers from arranging private trips, excursions, hotels and offering gifts or hospitality to visiting High Court judges.
"If arrangement in connection with an official visit of Hon'ble Chief Justice/Hon'ble Judges is required to be made by the District Judge or Chief Judicial Magistrate, all the bills shall be raised in the name of and the payment shall be made directly by the Hon'ble High Court to the extent permitted and no personal funds will be used by any Judicial Officer for this purpose."
They have also been restricted from providing any gift/ hospitality to the Chief Justice/High Court Judges.
It has further been instrcurted that no functions shall be organised during the visit of High Court Judges except at the cost of the government if there are written directions.
The Circular warns, disregard of the instructions will be seen as 'misconduct.'
