A 3-member special committee has recommended withdrawing the suspension of Advocate Pawan Kumar Tiwari, who had been suspended on account of rowdyism & misconduct during the election of Kanpur Bar Association held on Dec 17.
The committee members in their letter dated Jan 29, 2022 to the Bar Council of Uttar Pradesh said that one of the observers, Devendra Mishra Nagraha had submitted that the matter was under inquiry & disciplinary proceedings had been initiated & the suspension of Pawan Kumar might be withdrawn. Anurag Pandey, a member had also made the same submission & had supported the view of Nagraha, therefore, in view of it the suspension of Pawan Kumar be withdrawn.
During the voting of Kanpur Bar Association’s annual election, the observers and elders committee, all have witnessed the rowdyism & violence in which a Lawyer was shot dead. The Bar Council of Uttar Pradesh had taken a tough stand in this matter. It had constituted a three-member committee to inquire into the matter & recommend action against the advocates involved in rowdyism & violence. Bar Council of UP had suspended Pawan Kumar under disciplinary proceedings.
The special committee had sought reports from the Elders committee which was conducting the election. The chairman of elders committee in his submission had raised serious issues of indiscipline, violence & also criminal backgrounds of some candidates & stated that it had asked the executive committee to identify the lawyers who indulged in rowdyism & violence.
Ex-Presidents of the Kanpur Bar Association, in their representation, raised the question of competence of the elders committee. Meanwhile, Pawan Kumar preferred an appeal before the Bar Council of India against his suspension. The 3-member special committee in its letter clearly stated that considering the entire materials on record & report dated Dec 18, 2021 by the observers, prima facie serious case of misconduct was made out against the lawyers who indulged in rowdyism & violence & killing of an advocate.
