An elderly couple sued their local tailor for allegedly damaging an expensive silk sari that was given for stitching falls.
Following a Court battle lasting close to 2 years, a Bengaluru consumer forum recently ruled in the couple's favour. The Court ordered the tailor to refund the cost of the sari (Rs 21,975), apart from compensation of Rs 10,000 for the trouble caused to the couple.
On Aug 18, 2019, Mangala Evani, 65, of Judicial Layout in GKVK, received a Mysore silk sari from her 75-year-old husband, Evani, who had purchased it from a showroom. On Oct 29, 2019, Mangala & her daughter went to a neighbourhood boutique run by one Divya to get the falls of the sari stitched, apart from altering some other garments.
Divya promised to finish all tailoring/stitching work within a few days.
However, some days later, Divya called Mangala to inform her that the sari was burnt in a few places. Mangala demanded compensation, claiming the boutique had damaged her new silk sari. With no response for about 50 days, Evani & Mangala sent a legal notice to Divya for deficiency of service.
Demanding suitable compensation, the duo approached Bengaluru Rural & Urban 1st Additional District Consumer Disputes Redressal Forum in Shantinagar.
In litigation that commenced on Jan 18, 2020, the customers presented their claims through a lawyer, while Divya defended herself through her attorney.
Divya contended that the complaint was false as the customer had given her an old sari, which was previously burnt during ironing & that she was being wrongly held responsible for the damage.
Divya further said that owing to her busy work schedule, she had failed to examine the sari thoroughly before taking it.
'Boutique operator should have examined sari'
In proceedings lasting close to 24 months, judges of the Bengaluru consumer court noted that Divya was duty-bound to have examined the silk sari before accepting it, & trying to shirk off responsibly later, by claiming that she hadn't noticed the piece was damaged, wasn't acceptable.
In a verdict pronounced on Jan 13, 2022, the Judges ruled that the tailor must pay the value of the said sari (Rs 21,975), Rs 5,000 as damages & another Rs 5,000 towards the customers' court expenses.
The entire amount was to be paid within 30 days from the date of the court order.
