No bail from High Court too for Actor Armaan Kohli in NCB Case

  

On Monday, the High Court of Bombay denied bail to actor Armaan Kohli arrested in a case filed by the Narcotics Control Bureau (NCB) of drug seizure of 1.3 grams of cocaine, a small quantity. The Court however granted bail to 2 co-accused from whom no recovery was made in the case. The NCB had booked them for illicit trafficking, abetment & conspiracy.

The NCB had argued that the case can’t be dissected for each individual’s role as the crime is all part of the same thread, for the purposes of bail.

Kohli through his lawyer had argued for bail on the grounds that no case of illicit trafficking is made out & only a small quantity was alleged to be recovered.

However, the NCB in its reply said the bail ought not to be given alleging that serious charges of trafficking were made & probed.

Kohli’s bail plea was rejected first by a Magistrate on Sept 4.

The NCB reply before the special NCB court had said, “illicit drug trafficking is evident from material on record & the nexus with other co-accused from whom Commercial Quantity is recovered & are involved in illicit drug trafficking.’’ It had added that the actor’s role in “is apparent considering the nexus & connection with …(a co-accused) who is a big time peddler having criminal antecedents.’’ From that accused, the NCB said on July 28, it had seized an intermediate quantity of a drug called Mephedrone (MD).

It argued that the case of Kohli could not be considered in isolation.

Kohli was arrested on Aug 28 under the Narcotic Drugs And Psychotropic Substances Act.
