On Thursday, a Delhi Court sent former Maharashtra Home Minister Anil Deshmukh’s lawyer Anand Daga and CBI sub-inspector Abhishek Tiwari to two-day CBI custody in connection with the leak of CBI’s internal probe documents.
Anand Daga was detained on Wednesday from Anil Deshmukh’s Mumbai residence. The agency then brought Anand Daga, who was arrested in Mumbai, to Delhi on a transit remand.
The agency also conducted searches on the premises linked to Abhishek Tiwari in Prayagraj and Delhi.
Abhishek Tiwari, a sub-inspector-rank officer of CBI, was arrested on Wednesday after he allegedly accepted illegal gratification from people close to Anil Deshmukh. Sources said he was also allegedly in touch with a lawyer of Anil Deshmukh.
“CBI has registered a case against its sub-inspector, a Nagpur-based advocate and unknown others on certain allegations, including illegal gratification,” said CBI Spokesperson RC Joshi.
Anand Daga and Abhishek Tiwari were produced before a Special CBI Judge Vimal Kumar Yadav of the Rouse Avenue Court in Delhi on Thursday.
Advocate Tanveer Ahmed Mir, appearing for Anand Daga, told the court that CBI had not provided a copy of FIR.
CBI informed the court that “a secret operation is underway,” and that's why the FIR copy cannot be made public.
Tanveer Ahmed Mir argued that they won’t be able to understand the allegations unless they get a copy of the FIR.
CBI said that Abhishek Tiwari, sub-inspector of CBI, shared some confidential documents of the federal probe agency with Anil Deshmukh's lawyer Anand Daga and others in lieu of monetary benefits.
CBI sought seven-day custody of both the accused. However, the court granted CBI two-day custody of Anand Daga and Abhishek Tiwari.
As per sources, CBI officials also questioned Anil Deshmukh's son-in-law, Gaurav Chaturvedi, on Wednesday. He, however, was allowed to leave by the agency later.
The 65-page leaked documents, which were sent to various news organisations, suggested that CBI's investigative officer had opined that no cognisable offence could be made out against Anil Deshmukh and recommended closure of a preliminary inquiry.
However, an FIR was filed by CBI against Anil Deshmukh and others under corruption charges.
CBI conducted the preliminary inquiry on orders of the Bombay High Court. Several pleas were filed before the court after former Mumbai Police Commissioner Parambir Singh had alleged that Anil Deshmukh had asked terminated police officer Sachin Vaze to collect Rs 100 crore per month from the bars of Mumbai and via other means.
"On completion of preliminary enquiry (PE), the competent authority directed registration of a regular case based on evidence collected during PE and the legal opinion," said CBI.
After the internal documents came into the public domain, the Congress and NCP demanded an inquiry asking why the case was lodged against Anil Deshmukh when the CBI officer found no evidence of corruption.
The federal probe agency has tasked a special team to investigate how an internal probe report of the CBI was leaked and reached in the hands of people close to Anil Deshmukh.
