IndiaMart moves Bombay High Court claiming Just Dial filed false documents

  

IndiaMart has filed false and fabricated documents in the court in an ongoing copyright infringement dispute and sought an investigation against the database firm.

A division bench comprising of Justice Sunil Deshmukh and Justice Abhay Ahuja on Friday directed Just Dial, its founder VSS Mani and other board members to file their response to the B2B company’s petition and scheduled the next hearing for July 30.

In the application, BSE-listed IndiaMart alleged that the documents were filed by Just Dial without a certificate under Section 65B of the Evidence Act, which was a pre-condition for the admission of any electronic records, as it had not described the manner in which it obtained the documents.

Senior advocate Abad Ponda, who appeared for IndiaMart in the case along with Vikrant Singh Negi of DSK Legal, confirmed the filing of the intervention application. Just Dial wasn’t immediately available for comment.

This is the latest of petitions and cross-petitions filed by the two companies in the Bombay and Delhi high courts and before the Telecom Disputes Settlement and Appellate Tribunal against each other.

 

IndiaMart had filed the copyright infringement case last year, alleging that Justdial’s JD Mart B2B platform had copied its website compilations.

In its latest intervention application, IndiaMart said the rival company had fabricated evidence before the court and on the basis of that claimed that IndiaMart had been deleting or altering data from its website. This claim, the petition alleged, “is absolutely incorrect and misleading this court in an attempt to obtain an interim relief”.

In the plea, IndiaMart sought to make Internet search company Google India a party to the case, so that the court could verify its claim on the website data.
