HC upholds that majors are entitled to live in a live-in relationship

 Punjab and Haryana High Court 

On 22nd July, a bench of the Punjab and Haryana High Court consisting of Justice Arun Kumar Tyagi, reiterated that where the persons are major, they are entitled to live together in live-in-relationship and are also entitled to protection of their life and liberty against any harm even from the family members of such person.

Facts of the case:

The present petition had been filed under Articles 226/227 of the Constitution of India for issuance of directions to protect their life and liberty from danger at the hands of respondents. The petitioners have pleaded that the petitioners being 18 years and 20 years of age respectively developed love affair and are living together. Their relationship is acceptable to the family of boy but not to the family of girl and the petitioners apprehend danger to their life and liberty at the hands of respondents No.4 to 6.

Submissions of the petitioner:

Learned Counsel for the petitioners [Jagan Nath Bhandari] had submitted that the petitioners, who are living in live-in-relationship, made representation to the Senior Superintendent of Police, U.T. Chandigarh, seeking necessary protection but no action has been taken so far in the matter. Therefore, appropriate direction may be given for protection of life and liberty of the petitioners.

 

Submission of the respondent:

Learned State Counsel had submitted that statements of respondents No.4 and 5 had been recorded by the Police and respondents No.4 and 5 have stated that they have no objection to the live-in-relationship of the petitioners. However, learned State counsel has also no objection if appropriate direction is given for protection of life and liberty of the petitioners.

Order of the court:

 

After observing that both the petitioners are major the court held that are entitled to live together in live-in-relationship and are also entitled to protection of their life and liberty against any harm from respondents No.4 to 6.

The court directed the Senior Superintendent of Police, U.T. Chandigarh to look into the grievances of the petitioners as set out in the petition and also take appropriate action for protection of their life and liberty as may be warranted by the circumstances.

Thus, the petition was disposed off.
