The Madras High Court recently refused to entertain the plea seeking to include Aadhaar details in death certificates in order to aid the Election Commission in the removal of the names of deceased voters from the electoral rolls.
The Court recorded the petitioner’s submission that with the inclusion of Aadhaar details in death certificates, the Election Commission can check the status of persons claimed to be dead by their family or relatives.
However, the Bench of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy was of the opinion that that it is for the Election Commission to decide whether such measures are required.

The petition had sought directions so that necessary steps are taken to update the voter’s list by removing double entries and names of deceased persons.
Observation of the Court
The Court noted that the petition had become futile after the conclusion of State Legislative Assembly elections in April. The suggestion pertaining to the addition of the Aadhaar details in the birth certificate to enable the deletion of deceased voters’ names from the electoral roll.
“No doubt the petitioner’s suggestion will be considered by the Election Commission in trying to ensure that only such persons who are alive and entitled to vote to find their names on the electoral roll and others do not,” the Court said in its order.
Considering the same, the petition was disposed of. The Court further remarked that the Election Commission is free to opt for the apt procedure for updating the electoral roll.
