New Delhi: A Delhi court has ordered the police to file a fair investigation in connection with the Delhi riots in an FIR lodged by them.
The Delhi Police had closed the investigation in the case despite video recordings available against the accused.According to the Indian Express, the order passed by Metropolitan Magistrate Fahd Uddin on November 23 is related to Salim, a resident of Yamuna Nagar in Delhi, who alleged that his neighbors - Subhash Tyagi and Ashok Tyagi - attacked his house on 24 February this year. He has also accused that the neighbor also shot a person named Nasheer.
Police told the court that Salim is himself an accused in the riots and was arrested on 19 March. Delhi Police claimed that they had filed this false complaint to protect themselves. Currently Salim is out on bail.
After investigation in this regard, the police claimed that 'any cognizable offense was committed, it has been found and hence no FIR was lodged on Salim's complaint.' Thus the investigation was also closed.
However, the court rejected these pleas of the Delhi Police, saying that by looking at the materials available on record, especially the video footage of the alleged incident, it shows that there has been 'cognizable crime' here and these allegations need to be investigated by the police is.After this, the court directed the SHO of Zafarabad Police Station to file an FIR in the appropriate sections at the earliest on the basis of the charges and ensure that a fair investigation in the case is submitted to the court without delay.He also said that the DCP of North East Delhi, under whose jurisdiction Zafarabad falls, will supervise the investigation. Salim's complaint also names Naresh Tyagi, Uttam Tyagi and Supreme Maheshwari, who are accused in the 48-year-old Parvez murder case during the riots.While ordering the FIR, the court said, "These allegations are serious and are related to the protection of the complainant's right to live." Equal protection under the law cannot be denied to the complainant merely on the basis that there are some FIRs against him and the investigating officer feels that the allegations are false and the complainant has done so to protect himself. These conclusions have been drawn without FIR and independent and impartial investigation. '
