Uphaar Tragedy: SC seeks response of CBI on appeal of owners seeking return of property

 

On Thursday, the Supreme Court orally sought CBI's response on petition moved by the owners of Ansal Theatres seeking custody of the theatre and its premises.

The three-judge bench of Justice KM Joseph, Justice BV Nagarathna, and Justice Aravind Kumar was hearing the arguments from Senior Counsel R Basant from Ansal's side in an appeal filed in 2010.

He submitted that even after the victims were paid the compensation due, the possession of the theatre has not been handed over to them. It's been 26 years that the theatre has been lying vacant, he averred.

On the intervention of  Senior Counsel from Association of Victims of Uphaar Tragedy (AVUT), the bench pointed out that they are not a party to the case, hence it shouldn't be their concern. 

Asking how it will adversely affect them, the court rather suggested that it will help them be paid with the rest of the compensation.

 When the Counsel stressed that it is a matter justice and not money and pointed out that in a tragedy of such nature, if the real culprits go scot-free and the others serve sentences, it won't be right the bench opined that conviction of the accused and ownership of property are two separate matters.
