The Delhi High Court has issued Notice and sought the response of Delhi University for debarring NSUI (Congress's Student Wing) Secretary, Lokesh Chugh on premises that he organized a screening of the controversial BBC Documentary on PM Modi, ‘India: The Modi Question’ investigating role of the then CM in the infamous 2002 Gujarat Riots.
The petitioner, a Ph.D. research scholar at the Department of Anthropology at Delhi University has been debarred from appearing in any university/college/departmental examination for a period of one year.
The single-judge bench of Justice Purushaindra Kumar Kaurav remarked that University’s order doesn't reflect the application of mind.
“There has to be independent application of mind which is not reflected in the order… The order must reflect the reasoning,” it said.
When Counsels for the petitioner argued that the matter is urgent as last date for submission of his Ph. D. thesis is April 30th, the court assured that his rights will be protected.
The issue stems from protests organized in DU Campus in light of censorship of the documentary by the Centre. The petitioner has claimed that he was not present at the protests and was instead at a media interaction.
However, the University issued him a show-cause notice alleging that he was involved in disturbance of law and order in the campus. Eventually, a memorandum was issued for his debarring.
He has argued that the University didn't comply with the principle of natural justice as he was not even made aware of the charges probed by the Disciplinary Committee.
