In a rare 8 pm hearing, the Supreme Court on Friday stayed Calcutta High Court Justice Abhijit Gangopadhyay's order directing the Supreme Court secretary general to produce before him the transcript of his interview given to a news channel by midnight.
Earlier in the day, the Supreme Court directed the Chief Justice of Calcutta High Court to reassign the West Bengal teachers' recruitment case to another judge. The court's direction came based on a report submitted by the Registrar General of the Calcutta High Court over Justice Gangopadhyay's interview with a news channel, wherein he spoke about the case which he was hearing.
Justice Gangopadhyay had directed the CBI and the ED to question TMC national general secretary Abhishek Banerjee.
Hours after the Supreme Court's order, Justice Abhijit Gangopadhyay directed the Supreme Court secretary general to produce the transcript of his interview.Justice Gangopadhyay also sought the affidavit submitted by the Registrar General of the Calcutta High Court before the Supreme Court along with the official translation of his media interview in question by midnight today.
Justice Ganguly said he will wait in his high court chamber till 12:15 am (Saturday) to get the said two sets in original which were placed before the judges of the Supreme Court.
Following this, the Supreme Court convened a special hearing at 8 pm. A bench of Justices AS Bopanna and Hima Kohli noted that the order by Justice Gangopadhyay was "improper" and against "judicial discipline".
The Supreme Court directed Secretary General to send a copy of its order to the Registrar General of the Calcutta High Court immediately.
"The order of present nature ought not to have been passed in judicial proceeding keeping in view the judicial discipline. We hereby stay the order passed by the High Court judge in the suo motu proceeding. We direct Secretary General of Supreme Court to communicate this order to the Registrar General of Calcutta High Court forthwith who shall communicate the same to the High Court judge," the Supreme Court said in its order.
"As circumstances stand, no further proceedings in this matter required," the court noted.
