During the hearing of an anticipatory bail application of a rape accused, the Madhya Pradesh High Court flagged the issue of what it described as the 'appointment of incompetent Public Prosecutors and Government Advocates' who are not arguing and assisting the court properly.
The single-judge bench of Justice Deepak Kumar Agarwal in this view asked the Law Secretary to look into the issue and take appropriate steps.
“It is a matter of surprise that this Court is facing various difficulties while hearing the matters because incompetent Public Prosecutors/Government Advocates are being appointed by the State Government who are not properly arguing the matters and assisting the Court in helpful manner listed day to day basis,” he observed.
The case pertains to Rape on the Pretext of Marriage. The prosecutrix has stated that allegedly raped her, and later refused to marry her while the accused maintained that the case against him is false. The medical examination report revealed no external or internal injuries on her body.
The Court eventually granted anticipatory bail to the applicant on a personal bond of ₹ 25,000 with one solvent surety in the like amount.
