Advocate Prashant Bhushan (appearing for the victims) today urged to the Supreme Court bench that the trial in the Lakhimpur Kheri case is slow-paced. The bench opposed this statement today while hearing the matter and opined that the case is going on “not slow-paced”. Lakhimpur Kheri case is the one in which Ashish Mishra, son of Union Minister Ajay Mishra, was accused of the death of four farmers involved in a protest. On January 25, 2023, an interim order was passed granting interim bail of 8 weeks to Ashish Mishra as well as the other four accused. Today, the bench directed that this interim order will continue to operate.
During the hearing, Senior Advocate appearing for Mishra, Advocate Mukul Rohatgi, told the bench comprising Justices JK Maheshwari and Surya Kant that his client was appearing regularly at hearings but the prosecution’s witness 2 was not available. Further, he asked the top Court whether monitoring of the trial was necessary and the bench stated that “Let us continue with same status quo for some time. When the trial is on the right path and when the proceedings will continue smoothly, in an uninterrupted manner, at that stage we might withdraw ourselves. Right now, it is required.”
